1. Preface
Please read these Terms of Use (hereafter “Terms”) before using
- the Navcoin.org or any other website that is published by the Navcoin decentralized autonomous organization (hereafter Navcoin DAO)
or
- any related services, software or products that are provided by the Navcoin DAO.
All websites, services, software and products including the cryptocurrency tokens NAV and xNAV published and/or provided by the Navcoin DAO are hereafter collectively referred to as “Navcoin Services”.
The websites (hereafter “Navcoin websites”) that are published and maintained by the Navcoin DAO are:
- Navcoin.org
- Nav.community
- Navpay.navcoin.org

Navcoin is a decentralized and open-source, peer-to-peer virtual currency (generally also referred to as cryptocurrency) with advanced community governance mechanisms, Proof of Stake algorithm and user privacy protection features. The Navcoin DAO does not refer to any specific individual or group of individuals. The Navcoin DAO is an organization represented by rules encoded as a computer program that is transparent and open-source. It is self-funded, self-guided, self-governed and not influenced by a central government. Part of the Navcoin DAO can be anyone that engages in Navcoin by means of network validation, community engagement or by merely showing interest in the project. The Navcoin DAO is not controlled by any legal entity or individual.
These Terms govern your access to and use of the Navcoin Services. By using any of the Navcoin Services you agree to the Terms and our Privacy Policy and you confirm that you are legally allowed to use the Navcoin Services in the country of your residence.
2. No investment or financial advice
The Navcoin DAO does not provide individual or customized legal, tax, financial, or investment services. Since each individual’s situation is unique, a qualified professional should be consulted before making financial decisions. The Navcoin DAO’s tokens NAV and xNAV (hereafter collectively “NAV/xNAV” if explicitly referred to and not including any other of the Navcoin Services) are meant to be used as a medium of exchange. Nothing on the Websites constitutes investment advice or a solicitation to buy, hold, invest in, own, or use NAV/xNAV.
3. No liability for losses
The Navcoin DAO is not responsible for any damages, claims, or losses arising from the use of Navcoin Services, including the actions or inactions or events related to third parties, security problems, technical failures including data corruption and errors during the use of any of the Navcoin Services.
4. Disclaimer of warranties
The Navcoin DAO disclaims all warranties, representations and conditions of any kind, whether express or implied, including, but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement, with respect to the use of the Navcoin Services, or the accuracy, completeness, timeliness or currentness of their content, in any way and for any purpose.
5. Exclusion of consequential damages
In no event will the Navcoin DAO be liable for any incidental, special, consequential, exemplary or indirect damages or loss of data arising out of the use of or inability to use any of the Navcoin Services, even if the Navcoin DAO has been advised of the possibility of such damages.
6. Exclusion of limitations and disclaimers
Because some jurisdictions do not allow the disclaimer of warranties, or the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions the Navcoin DAO’s liability is limited to the greatest extent permitted by law.
7. Viruses and malware
The Navcoin DAO takes significant precautions to ensure the files available for downloading through the Websites are not tampered with. Appropriate SHA hashes are provided for end users to confirm that they have downloaded the correct file. Nonetheless, the Navcoin DAO cannot does not guarantee that files available for downloading through the Websites will be free of infection or viruses or other code that may have contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for integrity, security and accuracy of data input and output, and for maintaining a means external to the Websites for the reconstruction of any lost data. It is almost always advisable to check the SHA hashes of the files you have downloaded, and if in any doubt consider compiling software provided by the Navcoin DAO from the source code.
8. Prohibited use cases
You may use the Navcoin Services only for purposes that are conformable to law and in accordance with these Terms. You agree not to use the Navcoin Services:
- In any way that violates any applicable federal, state, local or international law or regulation
- For the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information or otherwise
- To send, knowingly receive, upload, download, use or re-use any material which does not comply with these Terms of Use
- To transmit, or procure the sending of, any advertising or promotional material without the Navcoin DAO’s prior written consent, including any "junk mail", "chain letter" or "spam" or any other similar solicitation
- To impersonate or attempt to impersonate another, or any other person or entity (including, without limitation, by using e-mail addresses or screen names associated with any of the foregoing)
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Navcoin Services, or which, as determined by the Navcoin DAO, may harm the Navcoin DAO or the users of the Navcoin Services or expose them to liability
Additionally, you agree not to:
- Use the Websites in any manner that could disable, overburden, damage, or impair the Websites or interfere with any other party's use of the Websites, including their ability to engage in real-time activities through the Websites
- Use any robot, spider or other automatic devices, process, software or means to access the Websites for any purpose, including monitoring or copying any of the material on the Websites
- Use any manual process to monitor or copy any of the material on the Websites or for any other unauthorized purpose without our prior written consent
- Use any device, software or routine that interferes with the proper working of the Websites
- Introduce any viruses, Trojan horses, worms, logic bombs or other material which is malicious or technologically harmful
- Attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Websites, the server on which the Websites are stored, or any server, computer or database connected to the Websites
- Attack the Websites via a denial-of-service attack or a distributed denial-of-service attack
- Otherwise attempt to interfere with the proper working of the Websites
9. Changes to the Websites
The Navcoin DAO may update the content on the Websites from time to time, but its content is not necessarily complete or up-to-date. Any of the material on the Websites may be out of date at any given time, and the Navcoin DAO is under no obligation to update such material.
10. Information about you and your visits to the Websites
All information collect on these Websites is subject to our Privacy Policy. By using the Websites, you consent to all actions taken by the Navcoin DAO with respect to your information in compliance with our Privacy Policy.
11. Links from the Websites
If the Websites contain links to third party websites and resources provided by third parties, these links are provided for your convenience only. This includes links contained in advertisements, including banner advertisements and sponsored links. The Navcoin DAO has no control over the contents of third party websites or resources and accepts no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third party websites linked on the Websites, you do so entirely at your own risk and subject to the terms and conditions of use for such third party websites.
12. Reliance on information posted on the Websites
The information presented on or through the Websites is made available solely for the purpose of general information. The Navcoin DAO does not warrant the completeness, accuracy or usefulness of this information. Any reliance you place on this information is at your own risk. The Navcoin DAO disclaims all responsibility and liability arising from any reliance placed on such materials by you or any other visitor to the Websites, or by anyone who may be informed of any of their contents.
The Navcoin DAO is not responsible, or liable to you or any third party, for the content or accuracy of any materials provided by any third parties.
